Xclusiv Retail Marketplace Innovation Vendor and Reseller Policy

1. Introduction

This Vendor and Reseller Policy ("Policy") outlines the terms and conditions under which vendors and resellers may operate on Xclusiv Marketplace ("Marketplace," "we," "us," or "our"). This Policy is designed to ensure that our customers receive high-quality products and services and enjoy a consistent and positive shopping experience on our platform.

2. Definitions

  • Vendor: A vendor is a manufacturer or supplier that sells products directly to the Marketplace or to resellers on the Marketplace platform.

  • Reseller: A reseller is an entity or individual that purchases products from vendors or suppliers to sell them to customers on the Marketplace.

3. Vendor and Reseller Agreement

By participating as a vendor or reseller on our platform, you agree to adhere to the terms of this Policy, as well as our Terms of Service, Privacy Policy, and any other relevant agreements or policies instituted by Xclusiv Marketplace.

4. Product Quality and Authenticity

  • Vendors and resellers must ensure that all products listed on the Marketplace are genuine, authentic, and meet applicable quality standards.

  • Products must not infringe on any intellectual property rights, including trademarks, copyrights, or patents.

  • Xclusiv Marketplace reserves the right to remove any products from our platform that violate our policies or pose a risk to our customers.

5. Product Listing and Pricing

  • Vendors and resellers are responsible for providing accurate and complete product information, including descriptions, images, specifications, and pricing.

  • Pricing must be transparent and fair, and comply with our pricing policies and applicable laws.

    1. Be the Seller of Record

  • You must always be the seller of record for your products. This means that you are responsible for accepting and processing orders, setting prices, and handling any customer service tasks related to your products.

    1. Identify Yourself as the Seller

  • All information included with the product, such as packing slips, invoices, external packaging, and other information related to the products, must identify you as the seller. You cannot have any information from the third-party supplier (who fulfills the order) sent to the customer.

    1. Be Responsible for Accepting and Processing Returns

  • You, as the seller, are responsible for accepting and processing returns of your products. This responsibility cannot be passed on to the third-party supplier.

    1. Compliance with All Amazon Policies

  • You must comply with all of Amazon's policies, including those related to product quality, shipping, customer service, and returns. Failing to comply can result in suspension or termination of your selling privileges.

    1. No Shipment from Another Retailer

  • You cannot fulfill orders using a product purchased from another online retailer and have that retailer ship directly to customers. If the supply chain involves another retailer who ships products directly to customers, this is not considered dropshipping by Amazon's definition and is against their policy.

 

11. Fulfillment and Shipping

  • Vendors and resellers must fulfill orders in a timely manner and comply with our shipping and delivery standards.

  • Products must be packaged professionally and securely to prevent damage during transit.

12. Returns and Customer Service

  • Vendors and resellers are responsible for accepting and processing returns of their products according to our return policies.

  • Customer service must be provided promptly and professionally, including addressing inquiries, complaints, and return requests.

13. Compliance and Monitoring

  • Vendors and resellers must comply with all applicable laws, regulations, and policies related to online retail and sales on the Marketplace.

  • Xclusiv Marketplace reserves the right to monitor compliance with this Policy. Non-compliance may result in suspension or termination of selling privileges on our platform.

14. Intellectual Property

  • Vendors and resellers must respect the intellectual property rights of others and not sell counterfeit, pirated, or unauthorized products.

  • Any alleged violations of intellectual property rights will be addressed according to our intellectual property policies.

15. Modifications to the Policy

Xclusiv Marketplace reserves the right to modify or replace this Policy at any time. We will provide notice of any changes by posting the updated Policy on our platform and updating the "Effective Date" at the top of this document.
